One more patch for temporary disability

In the current context of growing benefit expense on temporary disability, caused by various variables that have not been investigated in depth, the reform of the General Law on Social Security by Royal Decree-Law 2/2023 of 16 March, does not introduce any significant changes to solve the problem of a system that still fails to achieve the desirable balance between avoiding abuse in the receipt of the benefit and providing due protective action to those who exhaust their maximum legal period, while the clinical reasons for the medical leave persist. The new legal wordings merely eliminate the possibility of declaring an express extension after three hundred and sixty-five days, replacing it with a tacit extension, if the sick leave has not been discharged beforehand, while transferring to the INSS medical inspectorate the decision-making competence, until now entrusted to the INSS through the EVI.
