It is a question of arguing in law on the application of the rule in question. In short, it regulates the unfairness of the contractual termination of a worker affected by a declaration of permanent incapacity in any of its degrees, as long as the employer does not proceed to try to relocate the worker by applying any of the measures provided for by law. Their proven impossibility would make the intended termination possible.
