Reasonable adjustments as legality canon of the employers’ decisions

The entry into force of Law 15/2022 of July 12, Comprehensive for Equal Treatment and Non-Discrimination, perhaps unconsciously, has highlighted the significance that the legal concept of “reasonable adjustment” assumes when it comes to considering business decisions that entail the termination of the contractual relationship as not in accordance with the law when such decisions are based on issues related to discrimination based on the disability that may arise from the illness, the state of health, the state serological and genetic predisposition to suffer pathologies and disorders. The study that is now beginning is intended, therefore, to address that legal concept from a triple perspective –normative, jurisprudential and doctrinal– in order to present a snapshot of its legal regime in Spain.
