Abstract

Health surveillance, through medical examinations, is considered one of the most relevant instruments to ensure the safety and health of workers. Although the connection between health surveillance and the fundamental rights of workers, together with the business interest in complying with the obligation to guarantee health surveillance, causes a high level of conflict, which has been increased by the emergence of new emerging risks in the workplace. In this sense, the risks related to the pandemic, the implementation of digitization and artificial intelligence in productive organizations give health surveillance a greater role and force us to analyze the effectiveness of the regulatory framework in the face of new risks and challenges for the safety and health of workers.
