Benefits for Pregnancy Risk and Temporary Layoffs Due to Force Majeure: Commentary on Judgment 774/2025, of September 15 (Roj: Sts 3988/2025) of the Supreme Court)

The judgment analysis raises the question of whether, once maternity benefits have been granted to a worker, these benefits can be suspended because the company has been forced to suspend employment contracts due to a disruption of activity caused by force majeure, as occurred during the COVID-19 pandemic. Based on this premise, the analysis examines the relationship between the event that triggers the suspension of each contract—whether due to pregnancy risk or force majeure—and the resulting social security benefits, specifically those related to pregnancy risk
and unemployment. This analysis focuses on the legally protected interests in each case, paying particular attention to the fundamental role of maternity protection in our legal system. Each suspension scenario stems from different triggering events and the dynamics of each benefit, with special emphasis on the legal grounds that determine its termination.
