Abstract

This article establishes the elements to configure the damage to the life project in Labor Law, for which, we start by critically reviewing the contributions developed both by the jurisprudence of the Inter-American Court of Human Rights and by the doctrine, systematic and conception established by professor Carlos Fernández Sessarego regarding damage to the life project. With these elements, under a critical analysis and taking into account the jurisprudence of the Supreme Court of Justice of Peru, we developed a proposal on the configuration of the damage to the labor project considering: 1) Concept, recognition criteria, evaluation of the amount and the measures of reparation, and 2) Application in the field of employer responsibility as a category of compensation, establishing its concept, form of systematization and its location within the system of damages.
