THE APPLICATION OF COORDINATION RULES TO PRE-RETIREMENT BENEFITS

The growth in unemployment and the demands of modernisation of companies have made older workers a particularly needy group, whose protection has become a structural risk for any system of labour relations and social security. This article analyses the projection of this new contingency on the Community rules on the coordination of social security legislation. Firstly, it analyses the limitations and loopholes in Regulation 1408/71 with regard to pre-retirement benefits, and then examines the new features of Regulation 883/2004 and the effects of its entry into force for workers in Spain who are entitled to these benefits.
