RESPONSABILIDAD EXTRACONTRACTUAL DERIVADA DE LA ENFERMEDIAD PROFESIONAL

La resolución a comentar versa sobre la reclamación de cantidad, por responsabilidad extracontractual, como consecuencia de las lesiones sufridas por la exposición indirecta al amianto a la que estuvieron sometidas durante el periodo que sus esposos prestaron servicios profesiones a la empresa demandada, Uralita. Resulta de especial interés porque aborda la relación de los efectos perniciosos y perjudiciales del manejo de sustancias derivadas del amianto y la causa efecto en la inhalación de este producto pernicioso por las demandantes al lavar y planchar la ropa de trabajo de sus esposos, mientras prestaban servicios para la empresa demandada. Dando por acreditado el daño referido y la relación causa y efecto del mismo con la inhalación de amianto por parte de las actoras.
