PRESENTACIÓN DE LA ASOCIACIÓN INTERNACIONAL DE PROTECCIÓN SOCIAL
Con fecha 20 de Diciembre de 2023 se procedió a la constitución de la Asociación Internacional de Protección Social, firmándose su Declaración fundacional por una serie de Organizaciones de tres Continentes (Europa, América y Asia) que deseaban aunar esfuerzos para dar cumplimiento y extender los principios contenidos en la Declaración Universal de Derechos Humanos que, concretamente, en su artículo 25.1, establece “toda persona tiene derecho a un nivel de vida adecuado que le asegure, así como a su familia, la salud y el bienestar, y en especial la alimentación, el vestido, la vivienda, la asistencia médica y los servicios sociales necesarios. Tiene asimismo derecho a los seguros en caso de desempleo, enfermedad, invalidez, viudedad, vejez u otros casos de pérdida de sus medios de subsistencia por circunstancias independientes de su voluntad”.
Nunca hasta la fecha se había hecho realidad, en su totalidad, el concepto de Aldea Global acuñado por el sociólogo canadiense Marshall McLuhan. En efecto, las autarquías económicas y sociales se han ido diluyendo, dando paso a una apertura progresiva y generalizada de los mercados de bienes y capitales. De este modo, han ido declinando los bloques comerciales estancos, acentuándose las interdependencias económicas y las interrelaciones sociales.
Ahora bien, no es posible explicar la globalización desde una perspectiva estrictamente economicista sin referirnos asimismo a los aspectos laborales de la misma. De hecho, la globalización exige, para que pueda ser considerada como un elemento de progreso para toda la humanidad, del establecimiento de criterios comunes que eviten una distorsión de la competencia leal entre Estados. Sin embargo, si bien es cierto que no debe propugnarse una uniformización de condiciones de trabajo, salarios o protección social (lo que favorecería, fundamentalmente, a los Estados más desarrollados), tampoco es admisible la utilización torticera del dumping social para abaratar costes y obtener, de este modo, una situación ventajista que afectaría en especial, de forma más negativa, a los Estados menos desarrollados.
En consecuencia, la globalización no debe ser el pretexto o la excusa para eludir el mandato en materia de protección social emanado de la Declaración Universal de Derechos Humanos sino, por el contrario, debe concebirse como el mecanismo y la estructura que posibilite un mundo más igualitario y seguro. Y esa es, precisamente la pretensión que ha animado a la creación IASP-AIPS que nace con el afán de comprender y mejorar, en lo posible, el conjunto de actuaciones que amparan a todos los ciudadanos ante el denominado riesgo social en sus distintas variantes.
La IASP-AIPS congrega en su seno a diversas organizaciones nacionales que son sabedoras de que la globalización requiere, además de una profundización de la protección social a nivel interno, de un enfoque internacional que permita un mayor conocimiento de los distintos regímenes de Seguridad Social, posibilitándose, de este modo, una emulación de buenas prácticas legislativas. Es por tanto el primer objetivo de la IASP-AIPS el conocimiento dialéctico de los posibles riesgos y soluciones existentes, con miras a mejorar la situación del conjunto de los pueblos.
Por otra parte, la globalización no se refiere únicamente a la interconexión entre las diferentes naciones del mundo en el plano comercial, político y tecnológico, sino que también tiene que ver con el incremento geométrico de los movimientos de personas que circulan, en algunos casos, voluntariamente de un país, continente o hemisferio a otro u otros por motivos laborales o personales. No obstante, en paralelo, nos enfrentamos con el fenómeno de la migración forzada por razones políticas, climáticas o económicas. En cualquiera de estas situaciones voluntarias u obligadas, el elemento extranjero penetra en la pretendida coraza de los regímenes de seguridad social que, originariamente, fueron creados para la protección exclusivamente de los propios nacionales en el territorio nacional.
La respuesta de la Seguridad Social a la movilidad transfronteriza de la mano de obra no puede ser, en ningún caso, la armonización de los distintos regímenes sino la coordinación de los mismos. A este respecto los Reglamentos 883/04 y 987/09 de la Unión Europea, así como el Convenio Iberoamericano de Seguridad Social son un buen ejemplo de la internacionalización de la Protección Social que trasciende de los límites geográficos nacionales para extenderse por todo el orbe.
Resulta necesario subrayar que la coordinación interestatal de regímenes de Seguridad Social apuntala la necesidad de contar con una Asociación que permita ofrecer una panorámica abierta de las distintas legislaciones nacionales en un escenario de aprendizaje mutuo, respetando en todo momento la idiosincrasia de las diferentes sociedades.
La IASP-AIPS no desea competir con otras Asociaciones Internacionales ya existentes de Derecho del Trabajo y Seguridad Social. En este sentido, lo que reclama la IASP-AIPS es la especificidad de la Seguridad Social, recalcando su vocación internacionalista que requiere un tratamiento diferenciado y preeminente, no subordinado a un Derecho del Trabajo que está mucho más centrado en aspectos estrictamente nacionales. Por ello, la IASP-AIPS no surge del desgajamiento de antiguas organizaciones duales, ni pretende suplantar a ninguna de ellas. Al contrario, pretende una convergencia en pie de igualdad entre el Derecho del Trabajo y de la Seguridad Social, reclamando, eso sí, el papel autónomo que corresponde a esta última.
Los fundadores de la IASP-AIPS han sido conscientes de la importancia de la histórica Asociación Internacional de la Seguridad Social(AISS), integrada en la Organización Internacional del Trabajo (OIT), y de la Organización Iberoamericana de la Seguridad Social(OISS). De hecho la IASP-AIPS va a actuar como elemento potenciador de las mismas .En efecto, mientras éstas encuadran en su seno únicamente a Administraciones nacionales de Seguridad Social , la IASP- AIPS está formada por juristas , economistas , personal médico y otros expertos, constituidos en Asociaciones nacionales que pueden ofrecer un enfoque propio de la realidad presente y futura de la Seguridad Social, complementando la visión de las Instituciones públicas y facilitándoles o favoreciendo su encaje en el ámbito internacional .
No debería olvidarse tampoco el proceso de retroalimentación que ha generado, ya desde su creación, la IASP –AIPS. En efecto, si bien las Asociaciones nacionales de Seguridad Social son la base de nuestra Organización Internacional, ésta actúa, ,a su vez, como estímulo y acicate para la creación de otras Asociaciones en Estados que todavía no han ultimado ese proceso constitutivo , fortaleciendo asimismo las ya existentes .Con ello, se aspira a potenciar y extender en la sociedad en general la importancia trascendental de la Seguridad Social como vehículo para la consecución de la tan necesaria paz social. A este respecto, no debería olvidarse que éste fue el objetivo del Canciller Bismark cuando a finales del siglo XIX puso la primera piedra del Estado del Bienestar, del que todos somos legatarios.
Sin ánimo reduccionista, los fundadores de la IASP- AIPS, han priorizado las siguientes actuaciones finalistas que a continuación se detallan:
- Ilustrar la composición en los diferentes países del derecho fundamental a la protección social, tanto en el subsistema contributivo como en el no contributivo o asistencial;
- Contrastar el tipo de gestión (público o privado) prevalente en el sistema y determinar los puntos de conexión entre ambos;
- Determinar las fuentes de financiación, su administración, gestión y reparto entre las diversas contingencias;
- Analizar el cumplimiento del principio de igualdad entre la población masculina y femenina, adulta e infantil, en edad laboral y en retiro, y determinar la existencia de causas de discriminación entre las categorías en riesgo, por raza, color, orientación sexual, etc.;
- Comparar los perfiles de las distintas contingencias en cuanto a límites temporales, requisitos subjetivos y objetivos, condiciones financieras y/o de cotización, etc.;
- Confrontar los requisitos para la cobertura aseguratoria de categorías y situaciones transfronterizas, tanto migratorias, como de desplazados.
- Analizar las instituciones de precaución financiera, así como los fondos de garantía, de reserva y el reaseguro; y
- Detectar protecciones emergentes y menguantes, o dicho, en otros términos, de nueva creación o de supresión de contingencias protegidas.
La IASP está inscrita en el Registro de Organizaciones Internacionales de Naciones Unidas.

On 20 December 2024, the International Social Protection Association was set up, signing the founding Declaration by a series of organisations from three continents (Europe, America and Asia) that wished to join forces to comply with and extend the principles contained in the Universal Declaration of Human Rights which, specifically, in article 25.1, states that "Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control".
Never before has the concept of the “Global Village”, coined by the Canadian sociologist Marshall McLuhan, been fully realised. Indeed, economic and social autarchies have been diluted, giving way to a progressive and generalised opening of goods and capital markets. In this way, watertight trade blocs have been declining, and economic interdependencies and social interrelationships have been accentuated.
However, it is not possible to explain globalisation from a strictly economic perspective without also referring to the labour aspects of globalisation. Indeed, in order to be considered as an element of progress for the whole of humanity, globalisation requires the establishment of common criteria to avoid distortion of fair competition between States. However, while it is true that we should not advocate the standardisation of working conditions, wages or social protections (which would essentially favour the more developed States), neither is it acceptable to use social dumping to cut costs and thus obtain an advantageous situation that would particularly affect, in a more negative way, the less developed States.
Consequently, globalisation should not be a pretext or an excuse to evade the social protection mandate of the Universal Declaration of Human Rights but, on the contrary, it should be conceived as the mechanism and the structure that makes a more egalitarian and secure world possible. And it is precisely this intention that has encouraged the creation of IAPS-AIPS, which was born with the aim of understanding and improving, as far as possible, the set of actions that protect all citizens from the so-called social risks in its different variants.
IAPS-AIPS brings together various national organisations which are aware that globalisation requires, in addition to a deepening of social protection at the domestic level, an international approach which allows a better understanding of the various social security schemes , thus making it possible to emulate good legislative practices. The primary objective of IAPS-AIPS is therefore the dialectical understanding of possible risks and existing solutions, with a view to improving the situation of all peoples.
On the other hand, globalisation does not only refer to the interconnection between the different nations of the world on a commercial, political and technological level, but also has to do with the geometric increase in the circulation of people who move, in some cases, voluntarily from one country, continent or hemisphere to another or others for work or personal reasons. In parallel, however, we are confronted with the phenomenon of forced migration for political, climatic or economic reasons. In any of these voluntary or forced situations, the foreign element penetrates the intended shell of the social security systems which, in principle, were originally created for the protection of nationals themselves in the national territory.
The social security response to the cross-border mobility of the workforce cannot, under any circumstances, be the harmonisation of the different schemes, but rather their coordination. In this respect, EU Regulations 883/04 and 987/09 as well as the Ibero-American Social Security Convention are a good example of the internationalisation of social protection, which transcends national geographical boundaries to spread throughout the world.
It should be recalled that the inter-state coordination of social security schemes underpins the need for a partnership that provides an open overview of the different national legislations in a mutual learning scenario, while respecting the idiosyncrasies of the different societies.
IAPS-AIPS does not wish to compete with other existing International Associations of Labour Law and Social Security. In this sense, what IAPS-AIPS claims is the specificity of Social Security, underlining its internationalist vocation which requires a differentiated and pre-eminent treatment, not subordinated to a Labour Law which is much more focused on strictly national aspects. Therefore, the IAPS-AIPS does not emerge from the splitting of former dual organisations, nor does it intend to supplant any of them. On the contrary, it aims at a convergence between labour law and social security law on an equal footing, while reclaiming the autonomous role of the latter.
The founders of IAPS-AIPS were aware of the importance of the historical International Social Security Association (ISSA), integrated in the International Labour Organisation (ILO), and of the Ibero-American Social Security Organisation (OISS). In fact, IAPS-AIPS is going to act as an element that will strengthen them. In fact, while the latter include only national Social Security Administrations, IAPS-AIPS is made up of jurists, economists, medical personnel and other experts, constituted in national Associations that can offer their own approach to the present and future reality of Social Security, complementing the vision of the public Institutions and facilitating or favouring their integration in the international sphere.
Nor should it be forgotten that since its creation, the IAPS-AIPS has generated a process of feedback. Indeed, while the national social security associations are the basis of our International Organization, the latter in turn acts as a stimulus and spur to the creation of other Associations in States which have not yet completed this constitutive process, thus strengthening those already in existence, with the aim of promoting and spreading in society at large the transcendental importance of social security as a vehicle for the achievement of much-needed social peace. In this respect, it should not be forgotten that this was Chancellor Bismark's aim when he laid the foundation stone of the Welfare State at the end of the 19th century, of which we are all the heirs.
Without being reductionist, the founders of IAPS- AIPS have prioritised the following finalist actions, which are detailed below:
- a) To elucidate the composition in the different countries of the fundamental right to social protection, both in the contributory and in the non-contributory and welfare subsystems;
- b) Contrast the type of management (public or private) prevalent in the entire system and identify the points of connection between the two;
(c) Determining the sources of funding, its administration and management, and its allocation among the various contingencies;
- d) Analyse compliance with the principle of equality between the male and female, adult and child, working-age and retired populations, and determine the existence of causes of discrimination among the categories at risk, by race, colour, sexual orientation, etc;
- e) Compare the profiles of the different contingencies in terms of time limits, subjective and objective requirements, financial and/or contribution conditions, etc;
- f) Confronting the requirements for insurance coverage of cross-border categories and situations, both migratory and displaced.
- g) Analysing financial precautionary institutions, as well as such as guarantee funds, reserve funds and reinsurance; and
- h) Detect emerging and diminishing protections, or in other words, new creation or elimination of protected contingencies.
