Popular action is allowed only in the cases and forms expressly provided for in the Laws, resulting in the fact that in environmental matters there is no authentic public action of a general nature in our internal legal system, but rather it has been recognized only in some specific areas related to the environment.
Everyone having «the right to enjoy an environment suitable for the development of the person, as well as the duty to preserve it», as provided in article 45 of the Spanish Constitution, it would be convenient to regulate a generic popular action in the area of the environment, as occurs, for example, in the field of urban planning.
However, we see how, sometimes, the exercise of public action gives rise to harmful effects, which is why it is necessary to establish limits to it.
