Abstract

This paper aims to provide a theoretical framework to address legal interpretation issues related to reverse discrimination claims. In this area, there is a clear contradiction between an individualistic notion of discrimination, linked to the principle of formal equality, and a social notion of discrimination, related to the eradication of systemic inequalities between human groups. We assume that discrimination should always imply both individual and social harm, but that includes potential or hypothetical harm as well. From this perspective, various assumptions of possible reverse discrimination are analyzed to determine to what extent they are really related to the prohibition of discrimination.
