LA PLACENTA, MUCHO MÁS QUE UN ÓRGANO FUNCIONAL
Resumen
El pasado 28 de septiembre de 2016, de forma inédita, el Tribunal Superior de Justicia de Madrid se pronunció en un asunto concerniente a la bioética y el respeto por los derechos fundamentales de la persona. Sorprendentemente, eludiendo la reciente jurisprudencia del Tribunal Constitucional, el TSJ se exoneró de entrar en el fondo del asunto y avaló la usurpación a una madre y a un neonato, del derecho fundamental de mostrar a la Pachamama el máximo agradecimiento por el alumbramiento de un nuevo miembro de la familia humana. Todo ello, sin esgrimirse en el proceso una norma habilitante y sin justificarse la existencia de un riesgo real para la población o constatarse la interferencia en el ejercicio de un derecho individual en beneficio del interés general. En estas líneas trataremos de mostrar que la placenta humana es un nexo de conexión del neonato que ha de prevalecer frente a cualquier intento de catalogación y gestión sanitaria que vulnere la dignidad humana.
