The 2021 reform of Spanish Labour Law: an analysis of the reforming piece of legislation

Spain is undergoing an unprecedented process of reform, in terms of its scope and breadth, but also because of the way in which it is taking place, through a succession of legislative interventions in specific areas, preceded in most cases by social dialogue. It is in this context that social partners signed the agreement of 23 December 2021, which was implemented through Royal Decree-Law 32/2021 on urgent measures for the reform of labour law, the guarantee of job stability and the transformation of the labour market.
The aim of this paper is twofold: on the one hand, RDL 32/2021 is analysed from a formal perspective, focusing on its wording, legislative technique, structure and interweaving with the rest of the legal system. On the other hand, this regulation will be framed within the reform process in which it is part of.
RDL 32/2021 is an appropriate development of Component 23 of the Recovery, Transformation and Resilience Plan. It affects central institutions of Spanish labour law, modifying a significant number of legal provisions and generating the need for significant regulatory development. Its legislative technique is more correct than that of previous regulations, and an effort has been made to achieve gender-neutral language. In an overall assessment, it deserves a positive judgement from the perspective from which it has been analysed in this paper.
