Algunas consideraciones sobre la historia del derecho musulmán en España.

RESUMEN: En el presente artículo se realiza un recorrido por las principales aportaciones doctrinales, esencialmente jurídicas, a la historia del ordenamiento jurídico musulmán en Al-Andalus, o España Musulmana, haciendo hincapié en la reciente obra del Profesor Dr. Bruno Aguilera Barchet, Catedrático de Historia del Derecho y de las Instituciones, Iniciación histórica al Derecho musulmán. Seguida de un ensayo sobre la historia jurídica de Al-Andalus, obra jurídica didáctica y sólidamente construida, que se nos antoja fundamental para comprender el Derecho musulmán y el fenómeno del Islam, tanto en su dimensión histórica como actual, máxime teniendo en cuenta el hecho de que Al-Andalus y su Derecho forman parte de nuestra tradición jurídica.
ABSTRACT: In the present article, I present a review of the main contributions to the history of Muslim judicial ordinance in Al-Andalus, or Muslim Spain. I pay special attention to the recent work of Professor Bruno Aguilera Barchet, Historical Initiation to Muslim Law. Followed by an essay on the Legal History of Al-Andalus, which I consider fundamental to the understanding of Muslim Law and the question of Islam, both in their historic and present-day dimensions, particularly if we take into account the fact that AlAndalus and its laws form part of our legal tradition.
