La protección de los trabajadores autónomos por cese de actividad durante el estado de alarma y la protección tras su finalización.

Abstract

RESUMEN: Se analiza el régimen jurídico y la evolución normativa de la protección extraordinaria por cese de actividad establecida en el artículo 17 del Real Decreto-Ley 8/2020 y las diversas modificaciones producidas a lo largo de Estado de Alarma de esta prestación. También se analiza, de un lado, la ampliación de la protección por cese de actividad producida por el Real Decreto-Ley 24/2020, para facilitar el reinicio en la actividad permitiendo compatibilizar la actividad con el cese de actividad previsto en la Ley General de la Seguridad Social y, de otro, la prestación extraordinaria de cese de actividad previsto para los autónomos de temporada. Finalmente, se apuntan las medidas adoptadas por el Real Decreto-Ley 30/2020, de 29 de septiembre, de medidas sociales en defensa del empleo referidas al cese de actividad.

ABSTRACT: The legal regime and the regulatory evolution of extraordinary protection due to cessation of activity established in article 17 of Royal Decree-Law 8/2020 and the various modifications produced throughout the State of Alarm of this benefit are analysed. We also approach the study of, on the one hand, the extension of the protection for cessation of activity produced by Royal Decree-Law 24/2020, to facilitate the restart of activity allowing compatibility of the activity with the cessation of activity provided in the General Law of Social Security and, on the other, the extraordinary benefit of cessation of activity provided for seasonal self-employed. Finally, arts. 13, 14 and Additional Provision 4 which regulates the particularities of the benefit for cessation of activity established by Royal Decree-Law 30/2020, of September 29, on social measures in defense are analized.
