Abstract
RESUMEN: Aproximación al notariado público en el Cádiz de principios del XVI, a partir, en especial, de un pleito seguido en el Consejo Real por la ciudad contra el escribano real Diego González sobre la posesión de una escribanía de número local. El estudio se realiza en su doble vertiente, institucional y, en menor medida, documental y con preferencia desde la óptica de los documentos de la práctica sin desdeñar, no obstante, el marco legal. Así en lo institucional, se abordan aspectos tales como número de notarios ejercientes, nombramiento y acceso al oficio, tanto requisitos como vías oficiales con la casuística pertinente. En lo documental, se esboza el quehacer de los notarios a través de la visión de sus conciudadanos y, fundamentalmente, de los protocolos que confeccionaron y autenticaron.
ABSTRACT: Approaching the notary public in Cadiz at the beginning of the 16th century, especially after a lawsuit followed by the Royal Council of the city against the royal notary public Diego González on the possession of a local notary office. The study is carried out in both its institutional and, to a lesser extent, documentary aspects, preferably from the point of view of practice documents, without, however, disregarding the legal framework. Thus, at the institutional level, aspects such as the number of notaries practising, appointment and access to the office are dealt with, as well as requirements and official channels with the relevant casuistry. In the documentary field, the work of notaries is outlined through the vision of their fellow citizens and, fundamentally, through the protocols they drew up and authenticated.
