Resumen

El artículo plantea un análisis filosófico sobre el reciente reglamento de extranjería de España, aprobado por el RD 1155/2024 de 19 de noviembre de 2024, en cuanto dispositivo biopolítico. El presente análisis parte de una revisión documental de la normativa que regula la integración de los inmigrantes en España y da un paso desde el análisis jurídico hacia un estudio filosófico, enmarcado en el ámbito teórico-conceptual de la biopolítica propuesto por Achille Mbembe, Didier Fassin y Roberto Esposito. Metodológicamente, se propone el diálogo entre la normativa sobre la administración de la inmigración en España y la teoría contemporánea acerca del gobierno de la vida. El estudio defiende que el nuevo reglamento de extranjería de España institucionaliza las categorías de extranjeros útiles/inútiles a partir de una gestión diferencial de la vida basada en cálculos utilitaristas, tanto cuantificables, como categorías cualitativamente moralizadas; a partir de las cuales se decide quién merece vivir y quién debe morir, en términos jurídicos, en la gestión de las migraciones.
