THE IMPLEMENTATION OF FREE GENDER SELF-
DETERMINATION IN SPAIN

Resumen
La Ley 4/2023, de 28 de febrero, recien-
temente aprobada en España, regula la
autodeterminación de sexo en nuestro
país y garantiza la igualdad real y efec-
tiva de las personas trans y los derechos
de las personas LGTBI. El objetivo de
esta investigación es explorar los facto-
res socio-legislativos (socio-jurídicos) que
determinaron la elaboración de esta ley y
que explican su contenido, así como las
cuestiones controvertidas que conlleva.
La metodología utilizada es de carácter
exploratorio con el objetivo de identicar
y analizar a través del análisis de conte-
nido: los antecedentes, el contexto, los
actores sociales y el proceso legislativo.
Los resultados conrman la fuerte inuen-
cia de la Declaración de Principios de Yo-
gyakarta de 2005 y de los Principios de
Yogyakarta más 10 en la redacción inno-
vadora de las recientes leyes de género
de los diferentes países europeos, inclu-
yendo los pronunciamientos de la ONU en
2011 y 2016, y la propia ley española. Los
puntos de controversia han enfrentado a
partidos políticos e incluso a ONG femi-
nistas con colectivos LGTBI en aspectos
como el tratamiento hormonal de meno-
res, que ya ha generado jurisprudencia
disuasoria en Reino Unido y Suecia.

Abstract
Law 4/2023 of February 28, recently
approved in Spain, regulates the self-
determination of sex in our country and
guarantees the real and effective equality
of trans people and the rights of LGTBI
people. The aim of this research is to
explore the socio-legislative (socio-legal)
factors that determined the drafting of
this law and that explain its content as
well as the controversial issues involved.
The methodology used is exploratory
in nature aimed at identifying and
analyzing through content analysis: the
background, the context, the social actors
and the legislative process. The results
conrm the strong inuence of the 2005
Yogyakarta Declaration of Principles
and the Yogyakarta Principles Plus 10 in
the innovative drafting of recent gender
laws of the different European countries,
including the UN pronouncements in
2011 and 2016, and the Spanish law
itself. The points of controversy have set
political parties and even feminist NGOs
against LGTBI groups in aspects such
as the hormone treatment of minors,
which has already generated dissuasive
jurisprudence in the UK and Sweden.
